INTERNATIONAL FINANCE
AND FINANCIAL STRUCTURES
International businesses increasingly rely on the international finance markets to fuel their expansion. As these companies turn to the international capital markets for expansion, they are met with a host of international tax and regulatory concerns.
International capital markets rapidly move to respond to the dynamic global economic and trading environment. New opportunities are created as quickly as others are foreclosed. To facilitate our clients' access to international financial markets, we provide them with tax and legal advice, including:
- Project Finance Increasingly, financial institutions are willing to fund international development projects on a project finance basis. James Nobles LLC advises clients on the structure of their projects to qualify for project finance, and then represents them in implementing the project.
- Multilateral/Bilateral Financial Institution Backing Multilateral and bilateral lending institutions continue to play a major role in the financing of projects and transactions involving developing countries. James Nobles LLC has represented clients in accessing financing from the World Bank, the International Finance Corporation, the InterAmerican Development Bank as well as the U.S. Export-Import Bank.
- Intercompany Financing Techniques Many international groups have the financial strength to organize financing from within the group by leveraging their own financial resources with those from external sources to form an international finance company. James Nobles LLC advises these companies on the structure of finance subsidaries as well as their operation from a tax and financial efficiency standpoint.
- Letters of Credit Planning Letters of Credit remain the fundamental international credit tool. Our clients frequently issue letters of credit, borrow against them and/or assign them. We advise clients on international bank and regulatory requirements for letter of credit transactions.
- Cross-Border Equipment Financing One of the distinguishing hallmarks of international finance in the 1990s is the tremendous growth in cross-border equipment leasing and financing. James Nobles LLC advises clients in how to structure cross-border leasing, works with local counsel to ensure that a security interest is maintained in the equipment and structures international insurance to lower the total risk of the financing transaction.
